Matthew Hewerdine of Scalford then Knossington 1840 Will

This is the last Will and Testament of me Matthew Hewerdine late of Scalford but now of Knawston [Knossington] in the County of Leicester Carpenter as follows
First my Mind and Will expressly is to be buried in a decent manner in the Church yard in the Parish of Scalford aforesaid and that a Stone be erected to my Memory over my Remains and further that all my just debts funeral and Testamentary expences be fully paid
I Give an bequeath All my Personal Estate and Effects whatsoever and wheresoever and of what nature or kind the same may be of which I shall die possessed unto my friend William Clark of Melton Mowbray in the Said County of Leicester Auctioneer Upon Trust to convert such part thereof into money as may not be in Money and within Twelve months after my decease to divide and pay the whole of my said personal Estate and Effects unto and for the benefit of my Nephews and Neices hereinafter mentioned that is to say
Unto Ann, Matthew, Elizabeth, and Thomas Hewerdine (the children of my late brother John Hewerdine) Unto Ann, and Mary, (the children of my late Sister Mary Hewerdine) and to Mary, and Ann Shuttlewood, (two of the children of my late Sister Hannah Shuttlewood) their executors or administrators share and share alike
And my Mind and Will further is that my said Trustee be at liberty out of the said Trust premises to Retain all necessary costs charges and expences he may be at or put to in executing the said Trusts hereby Reposed in him and that he shall not be answerable for any loss which may happen to the said Trust monies unless the same happen through his own wilful neglect or default
And Lastly I do hereby appoint the said William Clark Sole Executor In Trust of this my last Will and Testament hereby Revoking all former Wills by me made
In Witness whereof I have hereunto set my hand and Seal this third day of March One thousand eight hundred and Twenty Nine

Signed sealed published and declared by the said Testator Matthew Hewerdine the Testator as and for his last Will and Testament in the presence of us who have at this Request in his presence and in the presence of each other set our hands as Witnesses to the due Execution thereof

I the within named Matthew Haverdine [?] Do declare this writing to be a Codicil to my Will within mentioned and I do direct the same to be taken as part thereof
Whereas I have appointed my friend William Clark therein named my Sole Executor Now I do hereby nominate my friend Thomas Dixon of Scalford Grazier to be an Executor jointly with the said William Clark under my said Will and to act in the execution thereof in every Respect as if he had been originally appointed
And do confirm my said Will in every other particular thereof
In Witness whereof I have hereunto set my hand and Seal this twenty eighth day of June 1836

William Clarke of Melton Mowbray in the County of Leicester Auctioneer and Thomas Dixon of Scalford in the said County Grazier the Executors in this will named were duly sworn to the truth and faithful performance thereof as usual and that the Goods Chattels and Credits of the deceased without deducting any debts owing by him therefrom do not amount in Value to the Sum of eight hundred pounds and that the deceased died on the Sixth day of February last past
