Articles of Agreement had made concluded & agreed upon by and between John Harby the Elder of Harby in the County of Leicester Yeoman of the one part & John Harby his Son of the same Towne and County Batchellor of the other part this Sixth day of July in the yeare of our Lord Christ One Thousand Six hundred Eighty & five In manner & forme following
Imprimis the sd Jno Harby the elder of Harby aforesd for & in good & valuable causes & considerations him hereunto moving but more especially for setting of my outward Estate on my Son Jno Harby aforesayd under the … Grants Articles & agreements as they are hereafter mentioned
Itm Tis covenanted concluded & agreed upon by and between Jno Harby the Elder & Jno Harby the Younger That the said Jno Harby the Younger shall & will pay unto his sister Elizabeth Harby spinster Daughter of the said Jno Harby the Elder the full & just Sume of Thirty pounds of good Currant & Lawfull Money of England & 3li worth of houshold stuffe at or within one yeare & halfe after the Sealing of theis present Articles
Itm it is further covenanted & agreed upon by the parties aforesaid that the said Jno Harby the Younger shall alsoe pay to his sister Anne Harby spinster Daughter of the sayd Jno Harby the Elder the full & just Sume of 30li of good currant lawfull money of England & 3li worth of houshould stuffe to be payd when she comes to accomplish the Age of one & twenty yeares
Item it is further covenanted & agreed upon by the parties aforesaid That if either of these two sisters happen to dye before their money be due to them that her portion that is dead shall fall halfe of it to be payd to her sister that is liveing & the sayd Jno Hardy the younger for to have the other halfe to himself
Itm It is farther covenanted concluded & agreed upon That the sayd Jno Harby the Elder & Jno Harby the Younger That the sayd John Harby the younger shall let his father have & receive the rent of Thomas Williams or of any other Tennant for that house dureing the naturall life of him the sayd Jno Harby if the sayd John the younger do hold the … soe long & likewise 2 Cowes One that he bought of Richard Healy of Eastwell & the other Cow which the sayd Jno the younger will at the sealing hereof And likewise to give to his sayd father 2 Ewes & Lambs one barren Ewe & 2 lamb hoggs att the sealing hereof
Itm it is further covenanted & agreed upon by the said John Harby the Elder & John Harby the Younger that the sayd Jno Harby the younger shall plowe & sowe dresse & over manure & till the sayd John the elder one halfe Oxgang of Land as … & orderly as he hath is own Land att all times & likewise to leade them to his now dwelling house or to any other house in Harby that the sayd Jno Harby the elder would have it lead unto As all corne & hay growing of the sayd halfe oxgang within the Liberty & precincts of Harby aforesayd And like to fetch one Cart load of pitt Coales every yeare during the naturall life of him the sayd Jno Harby the Elder that is for to say to doe all his land & worke dureing his naturall life
Itm it is farther covenanted concluded & agreed upon by & between the sayd Jno Harby the Elder & Jno Harby the Younger That the sayd John Harby the elder doe give unto John Harby the younger under the articles & covenants above rehearsed to bee fulfilled & kept I doe give to the said John the younger all my Leases houses Mares Filleys Colts Cowes Calves & young beasts & sheep whatsoever young and old but what before excepted And … Crop of Ground Cart & Cart Geares Plough & Plough Geares with all materialls & Implements whatsoever and [part of edge of page torn off, two or three words in each line] and all manner of houshold Goods but what before excepted moveables both in house & yard And [missing] or can be sayd to be my proper Goods to the sayd John Harby the younger & to his heires Executors [missing] assignes for ever If the said Jno Harby the younger he his heires Executors admors & assignes doe well [missing] or cause to bee payd alle my Debts as bonds bills rents or without bond or bill which I doe owe [missing] Sealing of theise Articles and all the other Covenants before expressed And likewise if the sayd [missing] Elder doe give to John Harby the younger full power & authority of all & every my Goods [missing] in what kind or manner soever itt may be found at the present Sealing of theise articles for [missing] that before excepted & performing the Covenants in full that is above written
In Witnesse hereof [missing] above sayd interchangeably hath to other hath hereunto sett theire hands & Seales this Tenth Day of July in the yeare of our Lord Christ 1682
