This is the last Will and Testament of me George Bates of Abb Kettleby in the County of Leicester Grazier
I Give and Bequeath all my plate linen China Books and other household furniture unto my two Sons and three daughters namely William George Mary Ann and Ruth Bates absolutely to be equally and fairly divided amongst them share and share alike
I Give devise and bequeath All the my Messuage or Tenement and Appurtenances belonging And two Closes of land situate in the Lordship of Abb Kettleby aforesaid And all other my Real Estate whatsoever and wheresoever situate And all other my Personal Estate and Effects (not hereinbefore by me specifically bequeathed) of whatsoever nature or kind the same may consist of and wheresoever situate (subject to the payment of the legacies hereinafter by me bequeathed and also my debts funeral and testamentary expences) Unto my Son William Bates his heirs executors administrators and Assigns
I Give and bequeath unto my Son George Bates the Legacy of Fifty Pounds absolutely
I Give unto my Son John Bates the Legacy of Fifty Pounds absolutely
I Give unto my Daughter Mary the Legacy of Fifty Pounds absolutely
I Give unto my Daughter Ann the Legacy of Fifty Pounds absolutely
And I give unto my Daughter Ruth the Legacy of Fifty Pounds absolutely
All which said Legacies I hereby expressly charge and make payable out of my Real and personal Estate hereinbefore devised and bequeathed to my Son William and direct that the same shall be paid by him to the several legatees within twelve months after my decease Provided and it is my Will and I hereby expressly direct that in case any of the last named Legatees shall depart this life in my lifetime leaving lawful issue Then and in that case I direct that the Legacy bequeathed to him her or them so dying shall go to and be equally divided between and amongst the issue of such deceased child or children such issue however only taking amongst them what would have been their deceaseds parents Legacy if living the Interest of such Legacies during the minorities of any of the Legatees to be applied to and for their benefit
With regard to the Legacy given to my said Son John who is now in Australia I make this special proviso that unless he makes application for the Legacy hereinbefore bequeathed to him within two years from the time of my death that such legacy shall become void and sink in for the benefit of my residuary Legatee but I expressly direct that he shall be immediately informed of my death and of the terms of upon which the said legacy is bequeathed to him
And it is my express wish and desire that in case any of my real Estate should after my decease be disposed of by my said Son William that he shall offer the same for Sale by public Auction
And lastly I hereby appoint my said Son William Bates Executor of this my last Will and testament hereby revoking all others by me heretofore made
In Witness whereof I the said George Bates the Testator have to this my last Will and Testament set my hand this fourth day of March One thousand eight hundred and sixty two

Proved at Leicester the fourth day of June 1870 by the Oath of William Bates Son of the deceased the sole Executor to whom Administration was granted
The Testator George Bates was late of Abb Kettleby in the County of Leicester Grazier and died on the twentieth day of November 1869 at Abb Kettleby aforesaid
