This is the last Will and Testament of me Thomas Daft of Sileby in the County of Leicester Retired Saddler
I direct my Executors hereinafter named to erect in the Church Yard or Cemetery in which I may be buried a Marble Tomb Stone in memory of my Wife and myself at a cost not to exceed Twelve pounds
I devise and bequeath all my Real and Personal Estate whatsoever and wheresoever unto my dear Wife Anna Daft for her life if she shall so long continue my Widow and from and after her decease or second marriage whichever shall first happen I devise and bequeath my said Real and personal Estate unto my friends Isaac Betts of Sileby aforesaid Rate Collector and Alfred Rendell Gibbs of Sileby aforesaid Builders Merchant Upon trust to sell and convert the said Real and personal Estate into money and after payment of the expenses attending such sale and conversion to pay and divide the monies arising therefrom unto and equally between and amongst such of the persons hereinafter named as shall be living at the decease or second marriage of my said Wife and in the manner following that is to say
One share to each of my Brothers William Daft and Samuel Daft and my Sisters Mary Ann Phipps Martha Hayes and Fanny Spray
One share in equal portions to the children of my deceased Sister Susannah Pearson who shall attain the age of twenty one years
One share each to William Thorpe Thomas Thorpe Daniel Thorpe Sarah Dexter and Eliza Preston Brothers and Sisters of my said Wife
One share in equal portions to the children of my said Wife’s deceased Sister Fanny Wood who shall attain the age of twenty one years and
One share to Henry Barradell the son of my said Wife’s deceased Sister Maria Barradell
Provided always and I hereby declare that in case any of them the said William Daft Samuel Daft Martha Hayes Fanny Spray William Thorpe Thomas Thorpe Daniel Thorpe Sarah Dexter or Henry Barradell shall die in my lifetime or during the life and widowhood of said wife leaving Children who shall be living at the death or second marriage of my said Wife then I declare that such children shall take and equally between them if more than one their respective parents share
And I further declare that if the said Mary Ann Phipps shall die in my lifetime or during the life and widowhood of my said Wife and shall leave her Husband William Phipps her surviving then the share of the said Mary Ann Phipps shall go and be paid to the said William Phipps if he shall be living at the death or second Marriage of my said Wife
And I further declare that if the said Eliza Preston shall die in my lifetime or during the life and widowhood of my said Wife and shall leave her husband William Preston her surviving then the share of her the said Eliza Preston shall go to and be paid to the said William Preston if he shall be living at the death or second marriage of my said Wife
Lastly I appoint my said Wife and the said Isaac Betts and Alfred Rendell Gibbs to be Executors of this my Will And I bequeath to the said Isaac Betts and Alfred Rendell Gibbs the Legacy or sum of Six pounds each in case they shall respectively accept and act as the Executors of this my Will
Lastly I hereby revoke all former Wills by me at anytime heretofore made
In witness whereof I have hereunto set my hand this second day of May One thousand nine hundred and one

This is a Codicil to the last Will and Testament of me Thomas Daft of Sileby in the County of Leicester Retired Saddler which Will bears date the second day of May one thousand nine hundred and one
Whereas Isaac Betts in my said Will named has lately died Now I hereby appoint my friend William Condon of Sileby aforesaid Nurseryman and Florist to be a Trustee and Executor of my said Will in the place of the said Isaac Betts and I declare that my said Will shall accordingly be read and construed as if the name of the said William Condon had been inserted therein throughout instead of the name of the said Isaac Betts
I bequeath to the said William Condon and Alfred Rendell Gibbs named in my said Will as an Executor thereof the sum of Three guineas each in case they shall respectively accept and act in the Executorship of my said Will And I hereby expressly revoke the Legacy of £6 each given to the Executors in my Will named And save as altered by this Codicil I confirm my said Will
