This is the last Will and Testament of me William Harwood of Harby Lodge Harby in the County of Leicester Farmer

I appoint my friend William Starbuck of Harby aforesaid Farmer and William Spencer of Harby aforesaid Grazier Executors and Trustees of this my Will

I give and bequeath to my Grand daughter Elizabeth Ann Goodson the sum of Five pounds to be paid to her free of legacy duty

I give devise and bequeath all the rest residue and remainder of my property whatsoever and wheresoever and whether real or personal unto my Trustees Upon trust to sell call in and convent into money my real estate and such part of my personal estate as shall consist of money and with and out of the proceeds of such sale calling in and conversion and with and out of such part of my personal estate as shall consist of money to pay my funeral and testamentary expenses and debts and the legacy hereinbefore bequeathed and subject thereto to hold the same as to four sixth parts thereof Upon trust for my children John Harwood Ruth Fairbrother Elizabeth Whittle and Martha Davies absolutely in equal shares as tenants in common

And as to one other sixth part Upon trust for my daughter the said Martha Davies and my grandson William Spencer in equal shares absolutely as tenants in common

And as to the remaining one sixth part Upon trust for Mary Ellen Cutforth of Redmile Station Leicestershire whom I have treated as a niece

And I declare that if any of them the said John Harwood Ruth Fairbrother Elizabeth Whittle Martha Davies William Spencer or Mary Ellen Cutforth shall die in my lifetime their share or shares in my residuary estate shall be held by my Trustees Upon trust for the person or persons who would have become entitled thereto had she or he survived me and died intestate

In witness whereof I the said William Harwood have to this my last Will and Testament set my hand this twelfth day of July in the year of our Lord one thousand eight hundred and ninety eight
