George Hives of Hose 1831 Will

This is the last Will and testament of me George Hives of Hose Miller in the County of Leicester as follows
First I direct that all my just debts funeral and testamentary Expences be fully paid
I give and bequeath all my personal estate and effects whatsoever and wheresoever and of what nature or kind the same may be of which I shall die possessed unto my two friends the Reverend William Goodacre of Sutton in Ashfield in the County of Nottingham Clerk and Thomas Hoe of Hose Lodge in the County of Leicester Farmer and Grazier their executors administrators and assigns upon trust they my said two friends or the Survivor of them or the Executors or administrators of such Survivor do and shall permit and suffer my affectionate Wife Mary Hives and her assigns the free use and enjoyment thereof during the term of natural life
And from and immediately after her decease Then I give and bequeath all my said personal Estate and Effects unto and amongst my sons and daughters George Hives John Hives Mary Ann Page Eileen Hives Ruth Hives Timothy Hives and Richard Hives and my Granddaughter Mary Hives equally share and share alike But in Case any of my said Children or Grandchild shall happen to die without issue before their said Shares become payable then I will that the share or Shares of him her or them so dying shall be paid unto and amongst the Survivors or Survivor in equal proportions
And my will is that my said trustees be at liberty to retain out of the said trust monies all expences they may be -at or put to in executing the said trusts And I appoint the said William Goodacre and Thomas Hoe joint Executors In trust of this my last Will and testament hereby revoking all former Wills by me made

Whereas George Hives late of Hose in the County and Archdeaconry of Leicester Miller deceased departed this life in the Month of October last having duly made and executed his last will and Testament in Writing and therein appointed his friends William Goodacre of Sutton in Ashfield in the County of Nottingham Clerk and Thomas Hoe of Hose Lodge in the County of Leicester Farmer and Grazier joint Executors and residuary Legatees in trust
Now know all Men by these presents that we the said William Goodacre and Thomas Hoe for divers good causes and considerations us thereunto especially moving do hereby expressly renounce not only the probate and execution of the said Will as the Executors thereof but also the letters of Administration with the Will annexed of all and singular the Goods chattels and Credits of the said deceased as the residuary Legatees In trust of the said Will And to the end that this our special Proxy of Renunciation may have its due effect in Law We do hereby nominate constitute and appoint John Stockdale Hardy Notary Public on of the exercent Proctors of the Commissary Court of the Archdeaconry of Leicester to exhibit this our special Proxy before the Worshipful Christopher Hodgson Master of Arts Commissary of the Right Reverend Father in God John by divine permission Lord Bishop of Lincoln Lawfully constituted his Surrogate or some other competent Judge in this behalf and to pray and procure the same and the Renunciation therein contained to be admitted and enacted and generally to act do and perform all and whatever acts matters and things that shall and may be requisite and necessary to be done on our behalfs in and about the premises and all and whatever our said proctor or in his absence any other proctor of the said Court shall lawfully do or cause to be done there We do hereby promise to ratify confirm and hold for firm and valid

On the 18th day of December one thousand eight hundred and thirty before the Reverend Richard Davies Clerk Bachelor in Divinity and Surrogate present the subscribed Notary Public
A Business of renouncing the burden of the Execution of the last will and testament of George Hives late of Hose in the County and Archdeaconry of Leicester Miller deceased and of decreeing Letters of Administration with the said Will annexed as herein mentioned

Upon which day Hardy exhibited a special Proxy and also Letters of Administration with the said Will annexed under the hands and seals of William Goodacre of Sutton in Ashfield in the County of Nottingham Clerk and Thomas Hoe of Hose Lodge in the County of Leicester Farmer and Grazier and alleged that George Hives late of Hose in the County and Archdeaconry of Leicester Miller deceased departed this life in the Month of October last having duly made and executed his last Will and testament and thereof appointed his two friends the said William Goodacre and Thomas Hoe joint Executors and residuary Legatees In trust who for divers good causes and consideration them thereunto especially moving have expressly renounced not only the probate and execution of the said Will as the execution thereof but also the letters of Administration with the Will annexed of all and singular the Goods Chattels and Credits of the said deceased as the residuary Legatees In trust of the said Will
Wherefore he prayed and the Surrogate aforesaid at his petition admitted the said special proxy and the renunciation therein contained and thereof decreed these Letters testimonial to be made Then the said Hardy exhibited for Mary Hives of Hose aforesaid and alleged her to be the widow and Relict of the said George Hives deceased and the beneficial residuary Legatee for life named in the said Will Wherefor he prayed and the Surrogate aforesaid at his petition decreed Letters of Administration with the Will annexed of all and singular the Goods Chattels and Credits of the said George Hives deceased to be committed and granted to her the said Mary Hives upon her being duly sworn and giving Bond with the usual security

In the Court of the Commissary of the Lord Bishop of Leicester in and for the Archdeaconry of Leicester
Appeared personally Thomas Hoe of Hose Lodge in the County of Leicester Farmer and Grazier and made oath that he is one of the Executors and residuary Legatees In Trust named and appointed in and by the last Will and testament of George Hives late of Hose aforesaid Miller deceased now hereunto Annexed and marked with the letter (A) and subscribed by this Deponent and that he this Deponent has duly renounced not only the Probate and execution of the said Will as one of the Executors thereof but also the Letters of Administration with the will annexed of all and singular the Goods Chattels and Credits of the said deceased as one of the residuary Legatees In Trust as aforesaid And the Deponent further made oath that he did on the day month and year the said Will bears date see the said deceased affix his mark to the same in the Manner and form as now appears and afterwards affix his seal thereto and did hear the said deceased publish and declare the said paper writing as and for his last will and testament in the presence of Robert Gibson of Hose aforesaid Cordwainer who thereupon with this Deponent set and subscribed their names as Witnesses thereto in manner and form as now appears (the several interlineations appearing in the said Will having been first made) And the Deponent lastly made oath that the said George Hives was at the time of signing sealing publishing and declaring his said last Will and testament as aforesaid of sound mind memory and understanding and the said Will is now in the same state plight and Condition as when executed by him as aforesaid

Bond, bound Mary Hives widow of Hose, Joseph Shilcock farmer and grazier of Hose and William Hourd innkeeper of Hose, £200 30 December 1830, condition bound Mary widow of George Hives miller to produce inventory and administer will.
