Thomas Swain of Hickling 1811 Will

This is the last Will and Testament of me Thomas Swain of Hickling in the County of Nottingham Miller as follows
I Give and Devise All my Messuages Cottages Mills Closes Lands Hereditaments and Real Estate situate standing lying and being in Hickling aforesaid or elsewhere in the Kingdom of England with the appurtenances and Also all my Personal Estate of what kind or quality soever the same may be unto my two friends John Collishaw and William Wright both of Hickling aforesaid Farmers their Heirs Executors Administrators and Assigns To hold the same and every part thereof unto my said two friends John Collishaw and William Wright their Heirs Executors Administrators and Assigns for ever Upon that special trust and confidence nevertheless that they my said Trustees and the Survivor of them his Heirs Executors Administrators and Assigns do and shall permit and suffer my dear wife Elizabeth Swain and her Assigns to receive the Rents of my said Real Estate and the Interest and proceeds of my said Personal Estate for and during such part of her natural life as she shall continue my widow for the support of herself and my two Children Mary Ann and Elizabeth Swain
And from and immediately after the Death or marriage of my said Wife which shall first happen Then upon further Trust that they my said Trustees and the Survivor of them his Heirs Executors and Administrators shall stand seized of and possess my said Real and Personal Estate and premises for the benefit and the support of my said two Children Mary Ann and Elizabeth until they shall attain their respective age or ages of twenty one years or day or days of Marriage and from and as soon as they attain such age or marry as aforesaid Then I Give Devise and bequeath all my said Real and personal Estate as aforesaid unto my said two Daughters Mary Ann and Elizabeth Swain their Heirs Executors Administrators and Assigns for ever
Provided that in case of the Death or Marriage of my said wife my said Trustees or the Survivor of them shall see right to sell and dispose of my Real Estate and premises to advantage I Give them such power and I hereby declare the Receipts or the Receipt of the Survivor of them my said Trustees their or his Heirs Executors or Administrators shall be a sufficient discharge or discharges for so much of the purchase money as shall be therein expressed to be received and that the purchaser or purchasers thereof shall not be accountable for the loss or misappropriation of the same And from and after such sale I direct my said Trustees and the Survivor of them his Executors and Administrators to place out the money to stand therefrom on good Real Security for the benefit of my said two Daughters their Executors Administrators and Assigns in equal shares
And Lastly after payment of my just Debts funeral and testamentary expenses I do hereby nominate and appoint my said two friends John Collishaw and William Wright joint Executors in trust of this my last Will and Testament hereby revoking all former Wills by me made

Signed sealed published and declared by the said Thomas Swain the Testator as and for his last Will and Testament in the presence of us who have at his request in his presence and in the presence of each other set our hands as Witnesses to the due executing thereof

I do hereby certify that on the 30th day of March in the year of our Lord 1811 John Collishaw of Hickling in the County of Nottingham Farmer and William Wright of Hickling aforesaid Farmer the joint Executors named in this the last Will and Testament of Thomas Swain late of Hickling aforesaid in the Diocese of York Miller Deceased were sworn well and truly to execute and perform the same And that the whole of the Goods Chattles and Credits of the said Deceased in the Diocese of York do not amount in value to the Sum of One hundred Pounds
